Title IX of the Education Amendments of 1972, as amended, prohibits discrimination on the basis of sex in any federally funded education program or activity. As such, Title IX mandates that no person shall be excluded from participation in or discriminated against on the basis of sex in programs or activities at educational institutions that receive federal financial assistance.
Sexual harassment is a form of sex discrimination prohibited under Title IX. Sexual harassment may be verbal, non-verbal, or physical in nature, such as persistent unwanted sexual comments and/or advances or requests for sexual favors. Sexual harassment also includes acts of sexual violence.
Both victim and the harasser can be either male or female, and the victim and harasser can be the same sex. In the workplace, the harasser can be the victim's supervisor, a supervisor in another area, a co-worker, or someone who is not an employee of UNCP, such as a visitor or vendor.
