The Director of Student Conduct receives information that a student has allegedly violated university policies or local, state, or federal law. The Director investigates the alleged violation and either dismisses the allegation or issues a notice of hearing to the student. In accordance with university regulations, the Director determines whether the case will be heard administratively or by the Conduct Hearing Board.
The notice of hearing includes the following: the charge(s), the type of hearing, an outline of the student's rights, and the opportunity to review all available information, documents, exhibits, and a list of witnesses who may testify.
Students and student organizations at UNC Pembroke accused of violating disciplinary or conduct rules may be represented by a licensed attorney or a non-attorney advocate during any disciplinary procedure, except in cases involving an Academic Honor Code violation. To be represented, the student must provide the Office of Student Conduct with three (3) required documents, which must be submitted at least three (3) business days before the scheduled hearing.
Once the case is heard, either administratively or by the Conduct Hearing Board, a determination of "responsible" or "not responsible" is made. The student will be notified of this determination in a notice of outcome. If the student is found responsible, appropriate sanctions will be determined. If the student is found not responsible, no sanctions will be imposed.

Request for Appellate Consideration
A student may request an appeal to the Appellate Officer within three (3) business days of receiving the notice of the decision by submitting a Request for Appellate Consideration form to the Director of Student Conduct. A link to the form will be provided in the notice of outcome.
The Appellate Officer is the Dean of Students or their designee for appeals involving only minor violations. For appeals involving serious violations, the Appellate Officer is the Vice Chancellor for Student Affairs or their designee.
Original sanctions (except summary suspension) are generally put into effect only after the Appellate Officer has made a decision. The Appellate Officer has the authority to approve, reject, or modify the sanctions.
Grounds for appeal are limited to:
- A violation of the Respondent's rights due to a significant deviation from the procedures outlined in the Code of Student Conduct.
- The sanctions and/or conditions of the sanctions are extraordinarily disproportionate to the violation(s).
- The discovery of new and significant information that would have affected the outcome of the hearing, which was not known or could not reasonably have been discovered and/or presented at the time of the hearing.

Holds can be placed on a student’s record for a number of reasons. While a student is going through the student conduct process a hold will be placed on their record until the process is completed. In addition, if a student fails to contact the Office of Student Conduct as instructed following a reported incident or does not complete assigned sanctions by assigned deadlines, a hold will be placed on their record.

The Family Educational Rights and Privacy Act (FERPA) has given colleges/universities the option to notify parents or guardians about specific types of information from a student's conduct record. The Office of Student Conduct will notify parents or guardians in writing the first time and every subsequent time a student is found to have violated Code of Conduct regulations on the use or possession of alcohol or other drugs when the student is under the age of 21.
